Maker of 5-Hour Energy Must Hand Over List of Ingredients
Legal documents were filed on Friday by the Oregon Department of Justice in an attempt to force the manufacturer of 5-Hour Energy to hand over a list of the popular energy drink's ingredients.
The legal action was filed against the companies responsible for the manufacture and marketing of 5-Hour Energy, including Innovation Ventures LLC, Living Essentials LLC and Microdose Sales LLC.
The list of ingredients will assist in a 33-state investigation into claims that anyone who drinks the two-ounce caffeinated beverage won't experience a post-use energy crash, that 73 percent of the 3,000 doctors polled recommended 5-Hour Energy, and that the beverage is safe for teens.
The U.S. Food and Drug Administration has received 92 reports involving adverse reactions suffered by consumers after drinking 5-hour Energy, including reports that link the product to heart attacks and fatalities.
Oregon's health fraud unit received documents from 5-Hour Energy in April, but all data regarding specific amounts of ingredients was redacted.
The legal action filed this week will require 5-Hour Energy to hand over unredacted data to the Oregon Department of Justice on or before February 15.
